1. Agreement to Terms
By accessing or using the Otto Power Company ("Otto," "we," "us," or "our") website at ottopower.co and our services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.
2. Services Overview
Otto Power Company provides solar panel and battery storage system design, installation, and related services for residential and commercial properties in Northern Indiana. Our website provides tools for generating ballpark solar system quotes, scheduling site inspections, and managing your project.
3. Ballpark Quotes
Online ballpark quotes are estimates based on satellite data and general assumptions about your property. They are not binding proposals or guarantees of pricing. Actual system pricing is determined after a professional site inspection and may differ from the online estimate based on site-specific conditions including roof condition, shading, electrical infrastructure, and structural requirements.
4. Inspection Fees
Site inspections require a non-refundable fee (currently $50 for homeowners, $200 per property for landlords). This fee covers the cost of a professional site assessment. If you proceed with installation, the inspection fee is credited toward the total project cost. Inspection fees are processed through Stripe and are subject to Stripe's terms of service.
5. Installation Agreements
Installation projects are governed by a separate installation contract executed between you and Otto Power Company. These Terms of Service govern your use of the website and online services; the installation contract governs the scope of work, pricing, timeline, warranties, and other terms specific to your project.
6. Payment Terms
All payments are processed securely through Stripe. By making a payment, you agree to Stripe's terms of service and privacy policy. Otto does not store credit card numbers or sensitive payment information on our servers. Payment schedules for installation projects are defined in your installation contract.
7. SMS Communications
By checking the SMS consent checkbox during inspection booking, you agree to receive text messages from Otto Power Company at the phone number you provide. Messages relate to your solar project, including inspection scheduling, project updates, appointment reminders, and two-factor authentication codes.
Message frequency varies based on project activity. Message and data rates may apply depending on your mobile carrier plan.
You may opt out at any time by replying STOP to any message. After opting out, you will receive a single confirmation message and no further texts. Reply HELP for assistance. Opting out of SMS does not affect other communications (email, phone) related to your project.
SMS consent is not a condition of purchase. You may receive a quote, schedule an inspection, and proceed with installation without opting in to text messages.
8. Account Registration
You may create an account to track your project, view documents, and make payments. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately if you suspect unauthorized access to your account.
9. Intellectual Property
All content on the Otto Power Company website — including text, images, graphics, logos, and software — is the property of Otto Power Company or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without written permission.
10. Accuracy of Information
We strive to ensure that information on our website is accurate and current. However, we do not warrant that all information is error-free. Solar production estimates, financial projections, and system specifications provided on the website are approximations and should not be relied upon as guarantees. Final specifications and projections are provided in your installation contract after a professional site assessment.
11. Limitation of Liability
To the maximum extent permitted by law, Otto Power Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services. Our total liability for any claim shall not exceed the amount you have paid to us in the twelve months preceding the claim.
12. Warranty Disclaimer
The website and its content are provided "as is" and "as available" without warranties of any kind, either express or implied. Equipment warranties and installation workmanship warranties are defined separately in your installation contract and manufacturer documentation.
13. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of Indiana, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts of the State of Indiana.
14. Changes to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the website after changes are posted constitutes acceptance of the revised terms.
